The two tribes have been in a decades-long dispute over protecting remains at the site of the casino

“Hickory Ground is sacred as the final resting place for some of the nation’s most significant military leaders, tribal leaders and spiritual leaders,” attorney for the Muscogee Creek Nation, Mary Kathryn Nagle, said in her opening argument in federal appeals court in Atlanta.

“We absolutely do have a longstanding attachment,” he told the court. “We have a shared history of that property with the Muscogee Nation.” RaeLynn Butler, Secretary of Culture and Humanities at the Muscogee Nation, said loopholes in federal laws allowed the remains to be mishandled. “We are Creek people from that area, and we have respected our ancestors,” she said, adding that the Poarch tribe has tried to work with the Muscogee Creek for a resolution. “The demand to tear the building down and put the ancestors back in place is unreasonable.”

Butler said repatriation is a human rights issue. She said their ancestors did not get the respect they deserved. “They have been disrupted on their journey and they have also been held hostage.”
