Supporters of the bill say this is common sense legislation, while those in opposition say it discriminates against transgender people.

The ‘What is a Woman Act’ officially defines the terms: man and woman, father and mother, boy and girl, and male and female based on a person’s biological sex at birth.“It remains essential that laws provide clear and objective definitions of male and female to protect the rights, safety, and well-being of all individuals and society as a whole,” said Bishop Jim Lowe, supporter of SB79.

However those who oppose this bill are concerned it will lead to further discrimination against transgender people and violate their right to privacy. “Legislation like SB79 claims that I am in fact a woman, though legally, that I have a right and obligation even to be in women’s spaces, like the bathroom or the changing room,” said Zephyr Scalzetti, opposed to SB79. “Do you want to walk into the women’s bathroom and see me?”

“This bill erases trans people, erases intersex people, and erases the experience of everyday Alabamians who know what a woman is and see one when they look in the mirror,” explained Emi Kennedy, who also opposes SB79.“We do need to pass this law for clarity, certainty, and uniformity in the courts and in the laws of Alabama,” said DuBose.Gov. Ivey said in her 2025 State of the State address that she supports the bill and looks forward to signing it when it reaches her desk.
