Attorney General Steve Marshall has asked the Alabama Supreme Court to put on hold the state’s request for a new execution date for Alan Eugene Miller to allow time to seek a resolution of Miller’s federal lawsuit against the state.

The victims were Michael Holdbrooks, 32; Christopher Scott Yancy, 28; and Terry Lee Jarvis, 39. Holdbrooks and Yancy worked at Ferguson Enterprises, while Jarvis worked for Post Airgas. Miller had worked with all three victims.
Miller claimed in his federal lawsuit that he requested to be executed by nitrogen hypoxia instead of by lethal injection during a time Alabama death row inmates were allowed to make that choice in 2018. U.S. District Judge Austin Huffaker Jr., held a hearing and found Miller’s claim credible, ruling that “it is substantially likely that Miller timely elected nitrogen hypoxia.”blocking the state from executing Miller other than by nitrogen hypoxia.
