PETALING JAYA: The Attorney General’s Chambers (AGC) will investigate the alleged leak of documents from a prosecutor recommending to the then Attorney General Tan Sri Tommy Thomas to drop six of the corruption charges in 2019 against former prime minister Datuk Seri Najib Razak and former Treasury secretary-general Tan Sri Mohd Irwan Serigar Abdullah, says current Attorney General Tan Sri Idrus Harun.

Idrus said he would not be commenting on the contents of the allegedly leaked 12-page internal memo, which had gone viral and picked up by political portals.“We are investigating the leak of the documents,” Idrus told The Star.

Meanwhile, Thomas, to whom the alleged leaked internal memo was made on Sept 10, 2019, said that he resigned from the post six months later without taking “a single file”.“Therefore, I cannot remember this at all, as I do not have any access to any of the AGC files now,” said Thomas when contacted. In the viral copy of the alleged internal memo from the AGC, the International Petroleum Investment Company prosecution team was concerned that a strong prima facie case could not be built for the six charges.

The said case referred to the charges against Najib and Mohd Irwan at the Kuala Lumpur Sessions Court on Oct 25, 2018, where the two were jointly charged with six charges under Section 409 of the Penal Code for breach of trust amounting to RM6.6bil in government funds involving payments to IPIC.On Dec 7, 2018, the case was transferred to the High Court.

Najib filed his first representation two years ago in his bid to have the charges dropped, but it was rejected. It was reported that Mohd Irwan filed his first representation in 2020 but was not replied to by the AGC, prompting him to send another representation in March this year.
