The Baker lockup is one of four centers in Florida where ICE holds immigrants in return for fees based on the number of people being held.
and said in the lawsuit filed Monday that it had scheduled meetings and “know-your-rights” presentations at the lockup Sept. 9. “On the morning of Sept. 9, the attorneys and law students arrived at the facility in person and were denied access by Baker employees,” said the lawsuit, which said jail staff claimed there was no room for the meetings to happen even though three attorney-client meeting rooms were sitting empty at that time.
The suit argues that not allowing the meetings violates free-speech rights of both the detained immigrants and the lawyers, as well as the immigrants’ rights to access counsel and due process under the U.S. Constitution’s 14th Amendment. Not allowing lawyers’ visits violates terms of ICE’s contract, the lawsuit argues, saying the visits are written into national detention standards. The suit also contends that Baker County Sheriff Scotty Rhoden and Sheriff’s Office staff are treating ICE detainees worse than other people held by the Sheriff’s Office and says there’s no justification for that. “Defendants’ refusal to permit detained individuals to meet with ACLU of Florida attorneys is expressly intended to punish individuals in civil detention and it subjects individuals in civil detention to more punitive conditions than those under which persons accused or convicted of crimes are confined,” civil rights lawyers argued in the lawsuit. The suit was assigned to Chief U.S. District Judge Timothy Corrigan but no action had been taken on the case by midday Tuesday.
