“I’m scared to damn death,” Carol Barnes said, fearing the criminal justice system abroad. She said her brother’s lawyer in Moscow, Gleb Glinka, told her the system is punitive, not judicial, and that 99 percent of the accused that go to trial are convicted. “I told somebody ‘if God can come down from heaven and have proof that David was 100 percent innocent, it wouldn’t matter to the Russians.”A U.S. State Department spokesperson said the agency is monitoring Barnes’ situation.

Koptyaeva first accused Barnes of sexually abusing his then 7-year-old in 2014, while the couple was in the middle of a divorce. In 2018, she accused him of sexually abusing their 4-year-old son and filed a petition to gain full custody of the children. Barnes suspected she would leave the country and filed an emergency motion requiring her lawyer to hold onto the children’s passport in 2018, said William Harrison, Barnes’ lawyer for his custody case.

The decision in the jury trial, said Barnes’ criminal attorney, Andrea M. Kolski, showed he had not harmed his children. “Because if they thought he had done something wrong, then they wouldn’t let him have regular custody with the son,” said Kolski. In December 2019, a Montgomery County judge granted Barnes full custody of his children, while Koptyaeva was criminally charged with interference of child custody. Koptyaeva remains wanted in the U.S., court records show.

“He called me Jan. 13, and he said 'Sis, I’m on my way to the police station,'” Carol Barnes said. “They just picked me up. My attorneys are going to meet me there for interrogation.’ That’s the last time I’ve heard my brother's voice.”
