However, Rocky's lawyer, Joe Tacopina, painted a different picture, arguing that Relli was a 'fraud' who fabricated a story to extort money from Rocky. Tacopina asserted that the gun seen in surveillance footage was merely a 'prop gun,' carried by Rocky for protection against potential attackers as advised by security personnel. He emphasized that Rocky had nothing to hide and that Relli's motivations were financial.The trial took an unexpected turn when the prosecution revealed new evidence submitted the previous night. This evidence involved two 9mm shell casings retrieved from the scene, which a new examination indicated were consistent with a 'Glock model 40 and 43.' Tacopina argued that this new evidence complicated the case unfairly and requested additional time for the defense to prepare. Judge Mark S. Arnold granted this request, pushing back the trial to Tuesday, January 28, 2025. The original trial date was November 2024 but was delayed due to a scheduling conflict.
