A divided panel said a state law that says a honk can only be used to warn of danger is not unconstitutional.
Honking your car horn for any reason other warning of imminent danger is still illegal in California, a federal appeals court has ruled.
That’s when a deputy pulled her over and gave her a ticket for violating the state law. While the ticket was dismissed later that year when the deputy failed to show up for the court hearing, Porter still filed her suit challenging the law. She also said it did not chill speech because there were ways for drivers to express support other than laying on the horn, like “waving, giving a thumbs up, or raising a fist as they drive by.”
