Prosecutors are trying to get the judge assigned to the case to recuse himself, and have appealed his initial denial.
Michael Baltimore is charged with shooting and killing one person in this barber shop and injuring another. His case is on hold as a result of requests by the defense and prosecutors that Judge Ed Guido recuse himself. .But Baltimore will have to wait a little longer to hear a jury’s opinion on the matter, because prosecutors are trying to knock the case’s judge out of the picture.from the trial to avoid the appearance of bias is the latest in a string of small developments for the case.
Under Pa. law, Guido is able to self-select from certain cases where he may hold a bias — which he did in the case of Seifullah Abdul-Salaam, who is asking for a new sentence for his first-degree murder conviction for the 1994 shooting death of New Cumberland police officer Willis Cole.Nothing else can be decided in the Baltimore case until the recusal matter is determined. Which means until the Superior Court hears the matter, the case is at a stand-still.
