Newly unsealed documents reveal detailed evidence against Khalid Sheikh Mohammed, the accused mastermind of the 9/11 attacks. The documents include his own statements, phone records, and videos allegedly used by al-Qaida in their attack planning.
Newly unsealed documents provide one of the most detailed glimpses yet into the evidence gathered against the accused 9/11 mastermind, Khalid Sheikh Mohammed . The summaries of evidence released Thursday encompass Mohammed's own statements over the years, phone records, and other documents alleging coordination between Mohammed and the hijackers.
These documents also include videos purportedly used by al-Qaida in their attack planning and prosecutors' summaries of government simulations recreating the flights of the four airliners on 9/11. While few specific details are provided in the summaries, the documents hint at the possibility of further revelations about the attacks yet to come. The newly revealed framework of the military prosecutors' potential case against Mohammed, who is accused of conceiving and executing much of al-Qaida's attack, is contained within a plea agreement that the Department of Defense is currently battling in court to overturn. Mohammed and two co-defendants agreed to plead guilty in the attack in exchange for life sentences. The Associated Press, The New York Times, NPR, The Washington Post, Fox News, NBC, and Univision are actively suing to unseal the plea bargains. The summaries of the prosecution's evidence were released Thursday in a partially redacted version of Mohammed's agreement. In an unusual step, as part of the plea agreement, prosecutors, defense attorneys, and the senior Pentagon official overseeing the cases at Guantanamo Bay, Cuba, agreed to a hearing that would allow them to publicly disclose the evidence compiled against the three. This measure appears designed to address concerns raised by families and others that a plea bargain might otherwise prevent the full release of the evidence. Another unique aspect of the deal required Mohammed to consent to answering questions from the families of the victims. Military prosecutors, defense attorneys, and Guantanamo officials negotiated the deal over two years under government auspices. The negotiations were an attempt to reach a resolution to the 9/11 case, which has been mired in pretrial hearings for over two decades since the attacks. Then-Defense Secretary Lloyd Austin intervened to try and void the plea agreement after it was announced, stating that waiving the possibility of the death penalty in such a grave attack was a decision that should be made by defense secretaries. Federal court hearings on the Department of Defense's efforts to overturn the plea agreements are ongoing. Legal disputes regarding whether the prolonged torture that Mohammed and other 9/11 defendants endured in CIA custody renders their statements inadmissible have further complicated the case. Repeated staffing changes at the Guantanamo court and the logistical challenges of holding a trial at a military base far from the U.S. mainland have also contributed to the delays
