A court clerk swore 88-year-old Jo Ann Nicholas in as she appeared briefly on Zoom from Nachitoches, Louisiana, where she lives. A doctor earlier signed an affidavit saying she was not well enough to travel to Houston for Gerald Goines’ trial, which remains unscheduled and in limbo.

The state’s motion originally pitched the questioning as if Nicholas was testifying in the trial. With all the lawyers in the courtroom, the judge would rule on objections and a court reporter would transcribe their questions and her answers. A later request asked that the courtroom be closed to the public.

The lawyers returned to the court about two hours into the questioning to ask for his ruling on questions concerning attorney-client privilege. The deposition comes five years after Nicholas’ daughter was killed alongside Tuttle at their Pecan Park home during the botched raid led by a team of Houston police narcotics officers. Nicholas has expressed concern with the actions of the narcotics officers in the past and sought to clear her daughter’s name.
