The bench will deliver its verdict in January after hearing the defense closing arguments. At the first-instance closing hearing in Criminal Division 33 of the Seoul Central District Court for Han, who is charged with aiding the leader of an insurrection, engaging in important duties related to an insurrection, and perjury, the special counsel sought this sentence. The special counsel said, “As prime minister, the defendant, as the top aide to the president and the No. 2 in the executive branch, had a duty to assist the president in advancing the national interest and to check the president when he exercised authority improperly,” adding, “Nevertheless, on December 3 last year, he abandoned the prime ministerial duty as a servant of the entire people and aided the unconstitutional and unlawful proclamation of martial law by former President Yoon Suk-yeol.” Han was indicted on charges of abetting the illegal proclamation of emergency martial law by failing to fulfill the duties of the vice chair of the Cabinet, who can preemptively check and control arbitrary exercises of presidential power. He is also accused of signing, on December 5 last year, a false martial-law proclamation document that former head of the Presidential Office Private Office Kang Ui-Gu drafted to conceal procedural defects after the declaration, together with former President Yoon and former Minister of National Defense Kim Yong-Hyun, and of asking that it be destroyed. He was additionally charged on February 20 with perjury for appearing as a witness in the Constitutional Court impeachment trial of former President Yoon and testifying to the effect that he ‘did not recognize the martial-law proclamation’. In the trial of Han, closed-circuit TV from the Presidential Office that showed, among other scenes, the Cabinet meeting before and after the December 3 proclamation of martial law was made public. The special counsel team concluded, based on footage showing Han holding documents, that he knew in advance about the emergency martial-law proclamation and went along with it. However, Han argued that he did not grasp the entire plan. He added, “Before the proclamation of martial law, I did not clearly use the expression ‘oppose,’ but I conveyed the position ‘please reconsider’ several times to former President Yoon.” Han said that he had no memory at all of the documents he brought out of the presidential office, but he acknowledged the perjury charge that he had stated he ‘did not recognize the martial-law proclamation’.
