5 years after the devastating spill killed at least 175,000 fish, residents near the river are left wondering when it will be made right.

The Mulberry Fork of the Black Warrior River near Sipsey in Walker County is among the sites that will benefit from the $3 million settlement paid by Tyson Farms after illegally discharging wastewater into the river. The projects were announced June 25, 2022. “We’re downriver from the plant, that’s where the major impact was,” said Martha Salomaa, a resident of the area near “the Forks,” where the Sipsey and Mulberry forks split. “We just don’t want to be forgotten.

Salomaa grew up in the Forks area. She is one of more than 70 landowners that sued Tyson Farms after the spill, alleging that it devalued their property. The Sipsey Heritage Commission, of which Salomaa is president, is also a plaintiff in the lawsuit, which is ongoing. in 2022 the company announced it would construct a $208 million replacement plant next to the old facility.

In the resulting settlement, Tyson had to pay the state $3 million, $1.5 million of which was placed in trust to benefit communities in Walker and Cullman counties. Another $500,000 was meant to increase public access to Mulberry Fork, with up to four new access points to the rivers. Poolos said that the state combined the two goals for some projects to pull from both pots of money.funded by the Tyson settlement—a new fire station and improvements to Garden City River Park.

Construction is expected to start in November and should be completed in the summer of 2025, Poolos said. It’s estimated to cost around $450,000.
