NBC 15 News has learned a judge ordered 5-year-old Mia Johnson and 2-year-old Jacob Johnson to be removed from the home the day they wereDerek filed for divorce in Mobile County in August, two days after Nancy accused him of domestic violence and a judge in Utah issued a protection order.
Derek accused Nancy of taking the children without his consent out of state. Nancy returned with the children to Alabama to appear before Mobile County Circuit Court Judge Walter Honeycutt for a September 20th custody hearing. According to a visitation order Honeycutt issued on September 26th, Nancy and Derek agreed to alternate custody weekly. A source familiar with the case tells NBC 15 News after the visitation order was issued, Honeycutt had a conference call with a judge in Utah and set an emergency hearing Thursday, September 28th. At that hearing, the source tells us Honeycutt verbally ordered DHR to remove the children from the home citing safety concerns. The sheriff's office also confirms Honeycutt gave the verbal order. There is no written order submitted in the court record explaining the reasoning, and it's not clear what prompted Honeycutt to make the move. The source tells NBC 15 News shortly after the hearing, Honeycutt and the attorneys who represented Derek and Nancy learned about the murder-suicide. Derek says Nancy was struggling with her mental health, which he says started to decline during the pandemic. He says she became consumed with conspiracy theories. "It started all with QAnon. And I would get phone calls at work from her saying there was going to be blackouts, that we needed to have a meeting point. She went from one thing to another. It just kept jumping and jumping to all sorts of things online. She couldn't see it was taking over everything that was important. It just continued and she refused to get any sort of help. She refused to let any sort of person intervene in our relationship, and you can't force someone to go get help," said Derek Johnson.
