हाई कोर्ट का बड़ा फैसला, पूर्व विधायकों की पेंशन और सुविधाओं को चुनौती देने वाली याचिका की खारिज इलाहाबाद हाई कोर्ट की लखनऊ खंडपीठ ने पूर्व विधायकों और विधान परिषद सदस्यों की पेंशन व अन्य सुविधाओं को चुनौती देने वाली जनहित याचिका खारिज कर दी है।संक्षेप में पढ़ेंइलाहाबाद हाई कोर्ट की लखनऊ खंडपीठ ने पूर्व विधायकों और विधान परिषद सदस्यों को पेंशन, पारिवारिक पेंशन तथा अन्य सुविधाएं दिए जाने संबंधी प्रविधानों को चुनौती देने वाली जनहित याचिका खारिज कर दी है। कोर्ट ने कहा कि पेंशन और अन्य सुविधाओं से जुड़े प्रविधान विधायिका के अधिकार क्षेत्र में आते हैं और इन्हें केवल नीति संबंधी असहमति के आधार पर असंवैधानिक नहीं ठहराया जा सकता। यह आदेश न्यायमूर्ति राजन राय व न्यायमूर्ति एके चौधरी की पीठ ने लोक प्रहरी संस्था के महासचिव एस.

शुक्ला की ओर से दाखिल जनहित याचिका पर पारित किया। याचिका में उत्तर प्रदेश राज्य विधानमंडल अधिनियम, 1980 की विभिन्न धाराओं को असंवैधानिक घोषित किए जाने की मांग की गई थी। याचिकाकर्ता का कहना था कि पूर्व विधायकों, विधान परिषद सदस्यों तथा उनके परिजनों को पेंशन, चिकित्सा, यात्रा और अन्य सुविधाएं देना संविधान की मूल भावना के विपरीत है। साथ ही सरकार को ऐसी सुविधाओं का भुगतान तत्काल रोकने का निर्देश देने की भी मांग की गई थी। सुनवाई के दौरान राज्य सरकार की ओर से कहा गया कि विधायकों को दी जाने वाली पेंशन कोई दान या अनुग्रह नहीं बल्कि विधायी कार्यों के दौरान दी गई सार्वजनिक सेवा के बदले निर्धारित वैधानिक सुविधा है। यह भी कहा गया कि ऐसे प्रावधान विधानमंडल द्वारा बनाए गए कानून के तहत लागू हैं और इन्हें मनमाना नहीं कहा जा सकता। पीठ ने दोनों पक्षों की दलीलों सुनने और अभिलेखों का अवलोकन करने के बाद याचिका में हस्तक्षेप से इनकार कर दिया। 'आधार कार्ड जन्मतिथि का प्रमाण नहीं', हाई कोर्ट ने याची की मेडिकल जांच कर उम्र का पता लगाने के दिए निर्देश
